2. Obtaining a Replacement or copy of your Statutory Declaration

Statutory Declarations for name changes are usually issued by solicitors – and the signed and stamped Statutory Declaration document issued to you would have been the only original, so no copy will exist. 

Also, unlike with Deed Polls, there is no central register of Statutory Declarations. So if you’ve lost your original Statutory Declaration, you have no alternative but to obtain a new Statutory Declaration. You will then need to have this sworn before a Commissioner of Oaths or a Justice of the Peace. 

However it’s perfectly acceptable to apply for a Deed Poll as a replacement for your lost Statutory Declaration. Deed Polls are by far the most popular and convenient method of changing a person’s name. For a start, a Deed Poll doesn’t need to be sworn before a Commissioner of Oaths or a Justice of the Peace; you simply order a Deed Poll.

Also, unlike Statutory Declarations, you won’t experience any problems with your Deed Poll being accepted by people as official documentary evidence of your change of name.

However before you apply for a Deed Poll to replace your lost Statutory Declaration you should read section 4 (below).
